Who these terms bind
They apply between Kalmit s. r. o., IČO 56160682, registered at Lermontovova 3, 811 05 Bratislava — “Kalmit” — and the business placing an order.
Kalmit supplies trade buyers rather than the public. Where a buyer nonetheless qualifies as a consumer, nothing here removes the rights the law gives them; where those rights conflict with anything below, the law wins.
Quotations and orders
Nothing on this site is an offer to sell at a stated price. Wholesale lighting is quoted per order, because quantity, specification and destination all move the figure.
A quotation sets out the fittings, quantities, price and lead time, and holds for thirty days unless it says otherwise. An order exists once the buyer accepts a quotation in writing and Kalmit confirms it — not when an enquiry is sent.
Prices and payment
Quoted figures exclude delivery and tax unless the quotation says they are included. Import duty and customs charges outside the EU customs territory are the buyer's responsibility.
Title in the goods passes on full payment. Risk passes on delivery.
Lead times and delivery
Lead times are quoted per order, because goods are sourced against the order rather than held in stock. They are estimates given in good faith.
Where a delay is caused by something outside Kalmit's reasonable control — a supplier failure, a strike, a customs hold — we will tell the buyer promptly and agree a revised date rather than cancel unilaterally.
Please inspect the shipment on arrival. Visible transit damage should be reported promptly on discovery so a claim can be made against the carrier.
Returns
Goods ordered to a buyer's specification are not stock items and cannot be returned simply because the buyer changed their mind. Kalmit will always confirm in writing before ordering where this applies.
A statutory right of withdrawal, where one applies, operates in addition to this clause and is not limited by it. Before returning anything, ask us: we will confirm in writing whether the item can be taken back and where to send it.
Warranty
Goods carry the manufacturer's warranty, passed to the buyer in full. The period differs by manufacturer and by product, so it is stated on the quotation for each fitting and repeated on the invoice. Where a fitting fails within it, Kalmit handles the claim with the manufacturer rather than leaving the buyer to pursue it.
It does not cover damage from installation by an unqualified fitter, use outside the stated IP rating, or modification of the fitting. Statutory guarantees run alongside and are not replaced by it.
Liability
Kalmit is responsible for loss that is a foreseeable result of breaking these terms or failing to use reasonable care, and is not responsible for loss that was not foreseeable when the order was placed.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Fittings must be installed by a qualified electrician in line with the wiring regulations that apply at the site. Kalmit is not liable for loss arising from installation that does not meet them.
Governing law
These terms are governed by the law of the Slovak Republic, where Kalmit is registered, and the Slovak courts have jurisdiction over any dispute.
Where a buyer contracts as a consumer, they keep the protection of the mandatory rules of the country in which they live.
